But in employing the system, which can scan millions of e-mails a second, the FBI has upset privacy advocates and some in the computer industry. Experts say the system opens a thicket of unresolved legal issues and privacy concerns.

    Het ministerie van Justitie wil via het mobiele telefoonverkeer de gangen van verdachten kunnen nagaan. Telefoonmaatschappijen zouden gegevens over de locaties van mobieltjes moeten bijhouden en op verzoek aan justitie afstaan.

    Today Britain became the only country in the world to publish a law which could imprison users of encryption technology for forgetting or losing their keys. The Home Office’s “REGULATION OF INVESTIGATORY POWERS” (RIP) bill has been introduced in Parliament: it regulates the use of informers, requires Internet Service Providers to maintain “reasonable interception capabilities”, and contains powers to compel decryption under complex interlocking schemes of authorisation.


    Op 3 november 1999 (kamerstukken 1999/2000, 23 530, nr 38) heeft de Minister van Buitenlandse Zaken de Tweede Kamer een lijst aangeboden met in voorbereiding zijnde verdragen. De lijst vermeldt ook de lopende onderhandelingen in het kader van de Raad van Europa over een Verdrag dat in de wandelgangen wordt aangeduid als Crime in cyberspace of cybercrime. Er is nog geen officile naam voor. Daar het Verdrag ingrijpende gevolgen kan hebben voor de verdere ontwikkeling van het Nederlandse recht op het gebied van informatiecriminaliteit lijkt het dienstig Uw Kamer in de gelegenheid te stellen meer in detail een oordeel te vormen over de Nederlandse inzet daarbij.

    Deze week bespreekt de Tweede Kamer het wetsvoorstel over de opvolger van de Binnenlandse Veiligheidsdienst: Algemene Inlichtingen- en Veiligheidsdienst. Als het aan de regering ligt krijgt deze dienst een brede taakomschrijving en zeer ruime bevoegdheden. Na kritiek vanuit de Tweede Kamer heeft de regering het wetsvoorstel op een aantal punten aangepast. Tegelijkertijd worden bevoegdheden op het gebied van afluisteren echter flink uitgebreid. Krijgt Nederland z’n eigen Echelon?

    Op 1 februari treedt de Wet Bijzondere Opsporingsbevoegdheden in werking. Tot in detail wordt hiermeee geregeld welke opsoringsbevoegdheden de politie wanneer mag gebruiken. En passant is in de wet een fikse uitbreiding op het gebeid van afluisteren geregeld: direct afluisteren. Ter uitvoering van de wet zijn er allerlei technische regels vastgelegd in :

Ook in Nederland heeft zich enige tijd geleden een zaak voorgedaan waarbij een verdachte werd verraden door zijn mobiele telefoon.     The US National Security Agency has designed and patented a new
    technology that could aid it in spying on international telephone calls.
    The NSA patent, granted on 10 August, is for a system of automatic
    topic spotting and labelling of data. The patent officially confirms for the
    first time that the NSA has been working on ways of automatically
    analysing human speech.

    als een stel knoeiende querulanten.
