Niemietz

Europees Hof voor de Rechten van de Mens 16 december 1992, NJ 1993, 400 m.nt. EJD (Artikel 8 EVRM)
Tegen Klaus Wegener werd in januari 1986 in Mnchen een procedure gestart wegens belediging. In een brief aan de rechtbank van Freising, ondertekend door ene Klaus W., werd namelijk de handelwijze van een rechter, tijdens een proces tegen een werkgever die uit overtuiging had geweigerd voor zijn werknemers kerkbelasting af te dragen, ondemocratisch en terroristisch genoemd. In het kader van dit onderzoek was een huiszoekingsbevel uitgevaardigd dat betrekking had op het kantoor van de advocaat Niemietz. Niemietz was een aantal jaren voorzitter geweest van de Antiklerikaler Arbeitskreis, een werkgroep van de Freiburgse partij Bunte Liste, waaraan Klaus Wegener verbonden was geweest (de voornoemde brief was blijkens het onderschrift geschreven in naam van Antiklerikale Arbeitskreis geschreven). Tot eind 1985 werd de post voor de Bunte Liste, naar het kantoor van Niemietz (klager in dit geding) gestuurd. Door middel van deze huiszoeking hoopten de autoriteiten meer over Wegener te weten te komen.

Rechtsvraag:
Was de huiszoeking in strijd met het recht op privacy, art. 8 EVRM?
Het Europese Hof:
A. Was there an interference ?
The court does not consider it possible or necassary to attempt an exhaustive definition of the notion of private life. However, it would be too restrictive to limit the notion to an Inner circle in which the individual may live his own personal life as he chooses and to exclude therefrom entirely the outside world not encpmpassed within that circle. Respect for private life must also comprise to a certain degree the right to establish and develop relationships with other human beings. There appears, furthermore, to be no reason of
principle why this understanding of the notion of private life should be taken to exclude activities of a professional or business nature since it is, after all, in the course of their working lives that the majority of people have a significant, if not the greatest, opportunity of developing relationships with the outside world. (...) Algemene overweging (31): More generally, to interpret the words private life and home as including certain professional or business activities or premises would be consonant with the essential object and purpose of Art. 8, namely to protect the individual against arbitrary interference bij the public authorities. Omstandigheden: Warrant issued a search for, and a seizure of, documents - without qualification or limitation. Examination of four cabinets with data concerning clients as well as six individual files. Conclusie: An interference with his rights under Art. 8.

B. Was the interference in accordance with law?
It was based on suspicion rather than facts and so did not meet the conditions laid down by Art. 103 Code of Criminal Procedure and since it was intended to circumvent the legal provisions safeguarding professional secrecy.

C. Did the interference have a legimate aim or aims?
Yes, the prevention of crime and protection of the rights of others.
D. Was the interference necessary in a democratic?
On the other hand, the warrant was drawn in broad terms, in that it ordered a search for and a seizure of documents, without any limitation, revealing the identity of the author of the offence letter; this point of special significance where, as in Germany, the search of a lawyer's office is not accompanied by any special procedural safeguards, such as the presence of an independent observer. More importantly, having regard to the materials that were in fact inspected, the search impinged on professional secrecy to an extent that appears disproportionate in the circumstances; it has, in this connection, to be recalled that, where the lawyer is involved, an encroachment on professional secrecy may have repercussions on the proper administration of justice and hence on the rights guaranteed by Art. 6 of the Convention.

Noot EJD: Kon men al uit het Chappell-arrest de conclusie trekken, dat een kantoor onder de privacy-bescherming valt, thans zegt het Hof ondubbelzinnig dat zakelijke activiteiten (en de ruimten van een individu) onder de bescherming van art. 8 EVRM. Het Hof komt daar langs drie wegen: 1. een groot deel van het individuele leven speelt zich af op het werk; 2. er is geen onderscheid te maken tussen priv- en zakelijke communicatie; 3. zakelijke activiteiten kunnen zowel op een huisadres als een kantooradres worden ontplooid. Twee aspecten, te weten het huisrecht en privacy op de werkplek worden verder in de noot nader belicht. Bijzonderheden: Vergelijk relationele (o.m. Chappell-arrest, NJ 91, 522 en Huvig en Kruslin NJ 1991, 523) en informationele privacy (o.m. Gaskin-zaak, NJ 91, 659).
