Hoe kan de rechtspositie van vreemdelingen in vreemdelingendetentie beter worden gewaardborgd?

Uit diverse onderzoeken komt naar voren dat vreemdelingen in vreemdelingenbewaring onder slechtere omstandigheden leven dan strafrechtelijk gedetineerden, waarbij de vreemdeling slechts beperkt toegang heeft tot rechtsbijstand (Inspectie voor Sanctietoepassing, 2006; Kalmthout e.a., 2005 I + II;). In een onderzoek dat is gedaan in opdracht van de Raden voor de Rechtsbijstand wordt geconcludeerd dat de kwaliteit van de rechtsbijstand voor vreemdelingen in vreemdelingendetentie in Nederland slecht is, en niet voldoet aan de wettelijke eisen (Jacobs e.a., 2006). Ook de Tilburgse hoogleraar van Kalmthout komt tot deze conclusie ((Kalmthout, 2005 – III).

The Single European Act (SEA) and the abolition of the internal borders within the European Community leaded to an increase in cross-border crime. Consequently the necessity for a closer co-operation between the European member states in the field of judicial matters and policing
increased. Yet this paradox of the necessity to Europeanise on the one hand, and the hallmarks of the policy field that make this Europeanization so difficult on the other hand, prove to cause serious problems for solid European police co-operation. Up until now the police co-operation between the European member states in the fight against organised crime is still far from perfect. Especially in the field of drugs problems do not seem to
decrease.
