De arrogantie van de macht

en in het Crimineel Jaarboek van de Coornhertliga, voorjaar 1999

‘Justitie en politie gingen over de schreef’ oordeelde de Nationale Ombudsman over het politieoptreden bij de Eurotop in 1997. De conclusies van het rapport dat in november 1998 verscheen hebben overal de krant gehaald, maar de inhoud bleef onderbelicht. En dat terwijl het rapport leest als een proeve van de arrogantie van de macht. De verantwoordelijken voor het politie-optreden waren niet eerder zo openhartig over hun beweegredenen en frustraties. De Eurotop moest ongestoord verlopen en dat doel heiligde alle middelen. Fundamentele kritiek wordt afgedaan als gezeur over details.

Op 15 en 16 oktober 1999 is er in het Finse Tampere een speciale Europese Raad gehouden over Europese samenwerking op het gebied van asiel, immigratie, politie en justitie. Over de verwachte ontwikkelingen op het gebied van asiel en immigratie hebben we het boek ‘Het Europees Asielbeleid in 2000’ uitgegeven.

Veel van de conclusies in Tampere hebben betrekking op de rol van Europol en het bevorderen van verregaande Europese politiesamenwerking. We zullen hier zoveel mogelijk documenten publiceren die via de Europese WOB verkregen zijn.

Heads of police from all the European Community’s member states, togehter with 87 heads of police from other countries and representavives fromt he European Commission met between the 29th January and the 2nd February 2001 in the Madrid police complex in Canillas to hold the 1st European Conference on Terrorism, organised by the Ministry of the interior of Spain and Europol.

The Spanish interior Minister, Jaime Mayor Oreha opened the conference and it was preside by Jurgen Storbeck, the German police commissar, who has led Europol since its beginning.

Betreft: Mogelijke wijzigingen van de Europol-overeenkomst en mogelijke uitbreiding van Europols bevoegdheden

1. Inleiding Deze nota snijdt twee vragen aan: is er, met het oog op de effectieve uitvoering van het Verdrag betreffende de Europese Unie, de conclusies van Tampere en het ontwerp-Verdrag van Nice, een wijziging van de Europol-overeenkomst nodig, en moet er een begin worden gemaakt met de discussie over de uitbreiding van de bevoegdheden van Europol?
Hieronder volgt een kort overzicht van de mogelijke wijzigingen van de Europol-overeenkomst. Worden die wijzigingen nodig geacht, dan wordt voorgesteld dit te regelen in een protocol tot wijziging van de overeenkomst.

Subject : Proposal for the extension of Europol’s mandate to the fight against cybercrime
The European Union needs to encourage the flowering of new information and communication technologies, but without thereby creating a security deficit, in order to develop its relations with the world and reinforce the advantages of free movement.

Concerning national rights, the Tampere European Council recommended directing our efforts towards crime which makes use of advanced technologies. More recently, at the informal JHA Council in Marseille on 28 and 29 July 2000, Ministers for the Interior and for Justice reaffirmed the importance of a European Union initiative in this matter.

Subject: First reflections concerning the Tampere Conclusions as far as they relate to Europol

1. Introduction

Article 30 (ex Article K.2.) of the TEU sets out the framework under which Europol should be further developed. It lists elements of a common action of Member States in the field of police co-operation and provides for a series of measures that should be undertaken by the Council within a period of five years after the entry into force of the Treaty of Amsterdam (five years after 1 May 1999)
